Introduction

This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between the owner and copyright holder of handytimers.com (hereinafter referred to as the "Copyright Holder") and any individual or legal entity (hereinafter referred to as the "User") who agrees to the terms and conditions specified in this document.

If you do not agree with the terms of this Agreement, please do not use the website handytimers.com.

1. Definitions

1.1. The Agreement uses the following terms:

1.1.1. Content - all objects available on the Site, including design elements, text, graphics, illustrations, videos, computer programs, databases, music, sounds, and other objects.

1.1.2. Site - an automated information system, accessible on the Internet at (including subdomains): handytimers.com

1.1.3. License - the right for the User to use the Site under a non-exclusive license while retaining the Copyright Holder's right to issue licenses to other parties.

1.1.4. User Account - a set of information about the User, recorded in digital format, necessary for identifying the User and providing access to their personal data, settings, and content.

2. Subject of the Agreement

2.1. The Agreement defines the terms and conditions for using the Site at handytimers.com. The subject of the Agreement includes all functions and services of the Site, as well as any developments or additions, available explicitly.

2.2. The Copyright Holder guarantees that they hold the exclusive rights to the Site as specified in section 2.1 of the Agreement. All exclusive rights to the Site are owned by the Copyright Holder.

3. Acceptance of the Agreement

3.1. This Agreement takes effect upon any use of this site.

3.2. The Agreement ceases to be effective upon the release of its new version.

3.3. The Copyright Holder reserves the right to unilaterally change this Agreement at their discretion.

3.4. The Copyright Holder does not notify the User of changes in the Agreement.

4. User License Terms

4.1. The User is granted a license to use the Site to the extent and in the manner established by the Agreement, without the right to grant sublicenses.

4.2. The license includes the following ways of using the Site:

  • Viewing Content: Users are allowed to view all available content on the site in accordance with the terms of this agreement.
  • User-generated Reviews and Comments: Users have the right to leave comments on the site content. All comments must adhere to established behavioral rules and must not contain prohibited information, such as insults, spam, or copyright violations.
  • Sharing Content: Users are allowed to share site content on other platforms with a mandatory link to the source. In doing so, the content placement must not violate copyright and intellectual property rights of the site.
  • Using Paid Services: Users may use paid services of the site in accordance with the conditions and rates described in the relevant section of the site or in an additional agreement.

4.3. No other rights are granted to the User, in particular, the User is not entitled to modify, process, distribute, or engage in other activities.

4.4. At any given time, the Site is provided "as is". The Copyright Holder does not guarantee that the Site will meet or will continue to meet the User's requirements, that access to the Site will be provided continuously, quickly, reliably, and without errors.

4.5. The User guarantees that they have all the necessary rights to the materials they publish on the Site (user content), allowing them to place the material on the Site and use it further according to the Site's functionalities. The User is solely responsible for ensuring that the content complies with applicable laws, including liability to third parties in cases where the placement of content or the content itself infringes upon the rights and legitimate interests of third parties, including the personal non-property rights of authors and other intellectual property rights of third parties.

4.6. The User grants the Copyright Holder a royalty-free, non-exclusive license to use the User Content, with or without attribution, without the obligation to report on usage, without needing specific permission from the User, and without payment of any royalties, globally. This includes the right for the Copyright Holder to sub-license such User Content to third parties. The Copyright Holder may use the User Content in any way on any information carriers, including reproduction, distribution, modification, public display, transmission via cable or broadcasting. The Copyright Holder is entitled to use the User Content on the Site, in other services and applications, in promotional or marketing materials placed on any resources. This license is indefinite and remains valid even if the User Content is removed from the Site. The Copyright Holder may continue to keep archive copies of the User Content and does not have to remove already created materials containing it.

5. Liability of the Parties

5.1. The parties are liable for failure to perform or improper performance of their obligations under the terms of this Agreement and applicable law.

5.2. The Copyright Holder is not responsible for the Site meeting the User's purposes.

5.3. The Copyright Holder is not liable for technical interruptions in the Site's operation. However, the Copyright Holder undertakes to take all reasonable measures to prevent such interruptions.

5.4. The Copyright Holder does not guarantee that the Site will meet the User's requirements, nor does it guarantee that the Site will operate with the software and hardware of other manufacturers without errors; it does not guarantee uninterrupted, error-free operation of the Site, nor the preservation of the User's data; it is not liable for the results obtained from using the Site or for direct or indirect damages incurred due to the use or inability to use the Site.

5.5. The Copyright Holder does not have the technical and factual capability to verify all information posted by Users on the Site for compliance with international laws and the terms of this Agreement, as such verification would impede the functionality of the Site. The Copyright Holder may decide to check such content at its discretion. The Copyright Holder cannot guarantee that the content complies with international legal standards or that it does not infringe upon the rights and lawful interests of third parties.
